Terms and Conditions

General Terms and Conditions

Article 1: Seller Identification

Varga Bratislava is the business name of Dwant, a sole proprietorship under Dutch law, run by Twan Jacobus van Dulmen.
Address: Merel 86, 1606 CJ Venhuizen, Netherlands (administrative address — this is not a store, pickup point, or return address)
Chamber of Commerce (KvK): 93031521 · VAT ID: NL004993711B72 · Establishment number: 000058600434
Email: info@vargabratislava.com — we reply within 24 to 48 hours.

Article 2: Scope

These terms apply to every offer and every distance contract concluded between the seller and the consumer. They are made available before the contract is concluded and can be saved. No provision deprives the consumer of rights granted by mandatory legislation.

Article 3: Offers and Pricing

Offers are non-binding and subject to change. Images and descriptions are indicative; color variations caused by display settings are not defects. Obvious errors by the seller are not binding.

Prices are shown in the currency you see at checkout. Since the item is shipped from a warehouse outside the European Union, the seller does not charge VAT. Upon delivery, customs duties, import VAT, and customs clearance fees may be charged. These amounts are borne solely by the customer, and the seller does not reimburse them.

Article 4 – Formation of Contract

The contract is concluded when the customer accepts the offer and fulfills its conditions. The seller will confirm the order electronically without undue delay. Each order is accepted subject to availability. The seller may decline an order if there are reasonable doubts about its validity or the payment.

Article 5 – Payment

Payment is due at the time of ordering through the methods offered on the website. Transactions are encrypted; we do not store payment card details on our servers.

Article 6 – Delivery

Delivery is made to the address provided by the customer, who is responsible for its accuracy. The stated timeframes are approximate. Accepted orders are fulfilled within 30 days at the latest, unless otherwise agreed; otherwise, the customer may withdraw from the contract at no cost and receive a refund. Risk passes to the customer upon handover of the shipment. Conditions are set out in our shipping policy.

Article 7 – Right of Withdrawal

The customer has a statutory period of 14 days from receipt to withdraw from the contract without giving a reason. Beyond the legal requirement, the seller provides a total period of 30 days: notice by email within 14 days of receipt, followed by 16 days to return the goods after our approval. The customer bears the return shipping costs. Conditions, exceptions, and a sample form are set out in our returns policy, which forms an integral part of these terms.

Article 8 – Conformity and Statutory Liability for Defects

The seller is responsible for ensuring that the item conforms to the contract upon receipt. The warranty period for defects lasts 24 months from receipt of the item, in accordance with the Civil Code and Directive (EU) 2019/771. Defects must be reported without undue delay at info@vargabratislava.com, with photos. The warranty does not cover normal wear and tear, improper use, or damage caused by the customer.

Article 9 – Complaints

Send complaints to info@vargabratislava.com with your order number. The seller will respond within 24 to 48 hours and will resolve the complaint within 14 days. Filing a complaint does not suspend the customer's obligations.

Article 10 – Liability

The seller's liability for direct damages is limited to the amount of the relevant order. The seller is not liable for indirect damages, or for delays, detention, or destruction of a shipment resulting from customs procedures or incorrect information provided by the customer. These limitations do not apply in cases of intent or gross negligence, personal injury, or where the law prohibits them.

Article 11 – Governing Law and Disputes

These terms are governed by Dutch law. The consumer retains the mandatory provisions of the law of their country of habitual residence and may bring proceedings before the courts of that country. The consumer may also contact an alternative dispute resolution body. In Slovakia, this is the Slovak Trade Inspection (www.soi.sk). The EU Online Dispute Resolution platform was discontinued on July 20, 2025; a list of bodies is available at consumer-redress.ec.europa.eu.
